Are You Eligible For Asylum?
There are two different ways to obtain asylum in America.
- Affirmative asylum — If you are physically in the U.S., you can make an application for asylum status regardless of how you got here or what your current immigration status is. You can apply, for example, even if you came into the U.S. on a valid visa.
- Defensive asylum — If you are already in deportation (removal) proceedings, you can apply for defensive asylum seeking to stop those proceedings. To be eligible, you will have to show a credible fear of fear of harm if you were returned to your home country.
